What Is the Stark Law? 

To protect your freedom of choice, the U.S. government created the Stark Law in 1989. Also called the Physician Self-Referral Law, this rule says that doctors can’t refer patients to certain services — like physical therapy, labs, or home health care — if the doctor or their family has a financial interest in that business. The law was designed to prevent conflicts of interest and ensure that your care is based on what’s best for you, not what benefits your doctor financially. 

If a doctor breaks this law, there can be serious consequences, including large fines and being banned from federal healthcare programs like Medicare and Medicaid. 

What Services Does Stark Law Cover?

The Stark Law applies to what are called “Designated Health Services” (DHS), which include: 

Physical therapy 

Occupational therapy 

Clinical laboratory services 

Home health services 

Prescription medications  

And several other specific services
